BACKGROUND

BrooksWatson & Co., PLLC, an independent audit firm, has audited the City’s financial statements for the period ending September 30, 2021, and has issued an unmodified or “clean” opinion. Louis Breedlove will provide highlights and comments on the ACFR and audit process. In accordance with Charter provisions (Section 7.18), an independent auditor has audited the City’s financial statements for the period ending September 30, 2021. It is the auditor’s primary function to express an opinion on the financial statements of the organization, but the organization itself has the primary responsibility for the remaining information presented (i.e., the financial statements, supporting schedules and notes). Management is responsible for the information presented in the financial statements.
 

The ACFR is composed of an introductory section, which includes the letter of transmittal and information about the entity; the financial section, which includes the auditor’s opinion, the Management’s Discussion and Analysis (MD&A), financial statements, notes to the financial statements, and required supplemental information; and, the statistical section, which contains various statistical tables and historical trend data.

 

OVERVIEW

The following are a few major highlights:

 

Professional auditing standards require the auditors to communicate directly with the governing body regarding the City’s internal control over financial reporting (Statement of Auditing Standards 115) and other relevant issues such as accounting policies, accounting estimates, disclosures, and management representations (Statement of Auditing Standards 114). The relevant letters are included in the supporting documentation for this item.

 

POLICY CONSIDERATIONS

The City’s financial statements have been prepared in conformity with Generally Accepted Accounting Principles (GAAP) as applied to governmental entities. It is the responsibility of the Finance Department to present financial information fairly in all material respects, so that the financial position of the City is not compromised. The desired result of the independent audit is to receive an “unmodified opinion.” The current report reflects an unmodified (clean) opinion, which is the highest opinion available. An unmodified opinion states that the governmental activities, the business-type activities, the discretely presented component unit, each major fund, and the aggregate remaining fund information of the City of Sachse, as of September 30, 2021, and the respective changes in financial position and cash flows, where applicable, thereof for the year then ended are in conformity with accounting principles generally accepted in the United States of America.

BACKGROUND

At the January 18, 2022, regular meeting, the City Council discussed and expressed a desire to create a Charter Review Commission. Staff received feedback from the initial discussion and researched compositions of charter review commissions in other municipalities in preparation for this discussion. Staff returned at the February 7 meeting to gain additional insights from the Council regarding the launch of a Charter Review Commission. Staff was asked to return with additional information and a draft charge for the Council's consideration. This presentation is a continuation of prior conversations and will summarize the discussion to this point.

BACKGROUND

The creation of a Charter Review Commission has been discussed at the January 18 and February 7 regular City Council meetings. The purpose of this item is to allow the Council the opportunity to appoint members to serve on a Charter Review Commission if they wish to do so.

 

OVERVIEW

To reach the minimum requirements within the Charter, each councilmember must appoint two residents to serve on the Charter Review Commission. Council may wish to consider an additional appointment if there is concern about a tie. 

 

POLICY CONSIDERATIONS

Section 11.07 of the City of Sachse's Home Rule Charter details the specific composition requirements of a Charter Review Commission. 

 

Section 11.07-CHARTER REVIEW COMMISSION

  1. The city council may appoint a Charter Review Commission of at least 14 citizens of the city who shall:
    1. Inquire into the operation of city government and determine whether any provisions require revision;
    2. Propose any recommendations it deems desirable to ensure compliance with Charter of the city government;
    3. Report its findings and present its recommendation to the city council
  2. The city council shall receive and have published in the official newspaper of the city a comprehensive summary of the report presented by the commission, shall consider any recommendations made, and may order any amendments suggested to be submitted to the voters of the city in the manner provided by state law as now written or hereafter amended.
  3. The term of office of the commission shall be for not more than six (6) months, at the end of which time a report shall be represented to the city council and all records of proceedings of the commission shall be filed with the city secretary and shall become public record.
