BACKGROUND

The Finance Department prepares a report each month to update the City Council regarding revenues and expenditures for the City. Included in the report are unaudited summaries for the General Fund, Utility Fund, Debt Service Fund, Sachse Economic Development Corporation, and the Sachse Municipal Development District, as well as a report of the year-to-date sales tax revenue.

BACKGROUND

The City's current Investment Policy was reviewed by City Council on November 1, 2021, in accordance with the Public Funds Investment Act (PFIA), the City's Investment Policy is to be reviewed on an annual basis, and the City Council must approve any modifications made thereto. The purpose of this agenda item is to present all recommendations for changes to policy and to comply with the annual review provision of the PFIA whereby each entity shall adopt a resolution annually attesting to an annual review.

BACKGROUND

The Texas Property Tax Code, Section 26.09(e) requires the City Council to approve the Appraisal Roll with tax amounts entered by the Assessor. The Collin County Tax Assessor Collector provided the attached 2022 Tax Roll Summary with a total levy of $8,437,605.16. Although the enclosed document is titled "Collin County", this refers to the Tax Assessor Collector, who performs tax collection for Sachse properties in Collin County.

Section 26.09(e) of the Texas Property Tax Code states that, "the assessor shall enter the amount of tax determined as provided by this section in the appraisal roll and submit it to the governing body of the unit for approval. The appraisal roll with amounts of tax entered as approved by the governing body constitutes the unit's tax roll."

BACKGROUND

The City's Comprehensive Financial Management Policy and Texas Local Government Code require certain purchases of goods and services to be competitively bid to ensure proper expenditure of the City's limited financial resources. Cooperative programs form a bridge between vendors and various organizations needing to meet similar fiscal due diligence. In general, cooperative purchasing ensures that the City is receiving an already bid price without having to use City resources to conduct a bid.

 

The City of Sachse has entered into cooperative purchasing programs for several years in an effort to streamline the procurement process, provide financial benefit or efficiency, and remain compliant with purchasing laws. Many of these cooperative programs have merged into larger programs to leverage better costs from vendors.

 

This item authorizes the City's participation in cooperative purchasing organizations. Separate agreements with other cities, such as the City of Grand Prairie, are handled separately through interlocal agreements. 

 

OVERVIEW

Agreements between cooperative purchasing programs and the City of Sachse range back as far as 1996. A centralized program where all departments are able to access and obtain information about the cooperative programs would prove beneficial, and further helps ensure fiscal due diligence when procuring goods or services. New cooperative programs are available that meet the demand for new technologies and further help the City remain fiscally responsible.

 

POLICY CONSIDERATIONS

Chapter 271 of the Texas Local Government Code authorizes a local government to participate in a cooperative purchasing program, and provides that purchases made by utilizing pricing and contracts from the cooperative program satisfy state laws requiring competitive bids for the purchase of goods or services.

 

Sachse's Comprehensive Financial Management Policy states that City guidelines on cooperative purchasing should not be construed as placing additional requirements on such purchases.

BACKGROUND

Swagit Productions, LLC (Swagit) offers hands-free recording, live-streaming, and uploading/archiving of public meetings. This service allows residents to access open meetings live or can be viewed at a later date. The City entered into an agreement with Swagit on April 23, 2018. Since that time, the request from residents to remotely view open meetings other than City Council meetings has grown and industry standards have improved. 

 

OVERVIEW

The City opted to start live-streaming all board and commission meetings beginning October 1, 2022. The current agreement with Swagit would not accommodate the increased number of meetings. Therefore, this amendment package provides for 100 meetings throughout the fiscal year and upgrades the system in the Council Chambers to include closed captioning. A one-time fee of Forty-Two Thousand, Eight Hundred Thirty-Five and No/100 Dollars ($42,835) covers the hardware, licenses, setup, and support services and will be paid with PEG money and General Fund budget. The yearly cost for the managed service package is Fifty-Six Thousand, Seven Hundred Ninety-Five and No/100 Dollars ($56,795) and was budgeted for FY 22-23 and will be paid from the General Fund.

 

As a reminder, Public, Education and Government (PEG) funds, may only be used on the capital acquisition associated with public broadcasting. Those funds may not be used to cover the ongoing maintenance and streaming services. 

 

POLICY CONSIDERATIONS

On September 21, 2005, the City Council approved an Interlocal Cooperative Purchasing Agreement between the City of Sachse and Collin County, which is permitted under the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code and Subchapter F, Chapter 271, Texas Local Government Code. In this agreement, Collin County acts as purchasing agent for the purchase of various goods and services through the competitive bidding process. As a member and participant in the cooperative program with Collin County, Texas, the City has met all competitive bidding requirements for the purchase of Swagit Productions, LLC products and services.

BACKGROUND

The Laurie Schwenk Senior Activity Center multipurpose room is used daily by the members of the center. The audio-visual system is used regularly for daily activities including bingo, exercise classes, announcements, background music, presentations from vendors, movies, etc. The current system is outdated and only works in one small section of the room. In addition to the members usage of the equipment, it would also be available for patrons to use the system when renting the facility.  

 

OVERVIEW

The audio-visual upgrades for the Laurie Schwenk Senior Activity Center Multipurpose Room was a supplemental budget request that was approved by the City Council in the FY 2022-2023 budget.  The approved budget amount was $83,074.76.

 

These audio-visual upgrades would update equipment for the Multipurpose Room as well as implement new features, such as streaming and videoconferencing support, additional video and audio input, a new wall-mounted control panel, and podium with A/V input and control panel.

BACKGROUND

The police department desires to replace an existing Chevrolet Impala and a Ford Explorer, each assigned as school resource officer vehicles, with two (2) Ford Explorers. The Garland Independent School District (GISD) has agreed to reimburse the city 50% of the purchase of the vehicles in addition to ancillary equipment costs associated with vehicle deployment.

BACKGROUND

The City Council established a Charter Review Commission in March 2022 with the following charge: “Review the City of Sachse’s home rule Charter to determine if any revisions need to be made to the document and make a recommendation to the City Council regarding the Commission’s findings.” Scott McMurdie, Charter Review Commission Chairperson, provided a summary report on behalf of the group at the July 18 Council meeting. The City Council reviewed and discussed the recommendations at the August 10 Special Council meeting. The Council directed the City Attorney to draft an ordinance calling a November election. Council approved an ordinance on August 15, 2022, ordering a Special Charter Amendment Election to be held on November 8, 2022.

 

OVERVIEW

In order to declare the results official, the City Council must canvass the results. The proposed ordinance will declare the results for:

 

POLICY CONSIDERATIONS

Title 6, Chapter 67, Section 67.004 of the Texas Local Government Code and the City of Sachse Home Rule Charter Article V, Section 5.04, requires the governing body to canvass and declare election results. Canvassing must be completed no earlier than three days after the election no later than eleven days after the election, by November 22, 2022. The City is meeting the statutory requirements.

BACKGROUND

Any unexpended or surplus revenue from the City's General Fund rolls into the unreserved fund balance. It is City policy, and an established best practice, to maintain a fund balance between 25 and 35% of operating expenses for emergency operations as a "rainy day" type contingency. The City of Sachse has exceeded this targeted amount in recent years. A portion of this was intentional, as the City was planning to tackle major capital projects using excess reserves. Unfortunately, the plan to address those reserves and pursue those capital projects was halted due to COVID-19. Additionally, the City received an influx of funds from both the CARES Act and the American Rescue Plan, creating additional funding opportunities for major capital expenses above and beyond what was anticipated using the excess reserves. 

 

City policy states that excess fund balance levels may be used to fund emergencies, nonrecurring expenditures, or major capital purchases that cannot be accommodated through the current year's budgeted revenues with Council approval. It was last estimated that there will be an excess fund balance of approximately $6.7 million at the end of fiscal year 21-22, as presented to Council on August 15 as a part of the fiscal year 22-23 budget process. While this number will change with the close of fiscal year 21-22 financial records, current projections are that the amount of excess fund balance will increase. As a result, staff prepared a drawdown plan for Council's consideration to reduce the reserves back to the policy-designated levels. 

 

POLICY CONSIDERATIONS

By policy, the City of Sachse sets aside in reserves 25 to 35% of the General Fund as a contingency (unreserved fund balance). The unassigned reserves exceed that targeted amount, leaving a balance of funds available for projects. City policy states that excess fund balance levels may be used to fund emergencies, nonrecurring expenditures, or major capital purchases.

 

RECOMMENDATION

Discuss and consider a drawdown plan for the City of Sachse's unreserved fund balance. Staff recommends lowering the amount of unreserved fund balance back to the 25 to 35% of operating expenses designated level set by policy.

OVERVIEW

The City of Sachse's Capital Improvement Plan (CIP) is a road map by which the City plans and completes key short-term and long-term infrastructure and facility projects.  The CIP includes maintenance and expansion projects throughout the city, including streets, public utilities, drainage, parks, facilities, and special projects. 

 

POLICY CONSIDERATIONS

The City performs updates to the Capital Improvement Plan (CIP) on an annual basis as a part of the budget process. In addition, the City has a long-range list of capital project needs.

BACKGROUND

The City of Sachse utilizes the PASER system to analyze and score streets based on pavement condition. This information is utilized by City staff and the City Council on an annual basis to rank streets in the community and determine which streets are in need of rehabilitation.

 

OVERVIEW

Staff has identified Williford Road, Blackburn/Ingram Road, and Ben Davis Road as roadways in need of major asphalt rehabilitation.

 

The 2022-2023 Capital Improvement Plan (CIP) included Williford Road Rehabilitation (R-23-01) for asphalt street repair. Blackburn/Ingram Road and Ben Davis Road are in need of repair but were not identified in the current CIP. Street Maintenance Tax and Street Maintenance and Operations budgets will be utilized for major repairs to these asphalt streets. 

 

This item authorizes a temporary overlay of Williford Road to extend its useful life due to the timing associated with the Bond 2021 program. Williford will be completely reconstructed as a part of the authorized Bond 2021 program, but it will take several years to complete due to design work and staggering of other bond projects. As a result, this overlay will provide temporary relief much like the Bailey Road overlay.

It is the responsibility of the City of Sachse to maintain, upgrade, and improve public roads as necessary in the City of Sachse. Chapter 791 of the Texas Government Code, also known as the Interlocal Cooperation Act, and Chapter 271.102 of the Texas Local Government Code, authorizes all local governments to contract with each other to perform governmental functions or services including administrative functions normally associated with the operation of government such as purchasing of necessary equipment, goods, and services. The City Council has approved the Master Interlocal Cooperative Purchasing Agreement with the City of Grand Prairie for the purchase of necessary equipment, goods, and services (Resolution No. 3360). Contract pricing from the City of Grand Prairie may be utilized by the City of Sachse for asphalt roadway improvements.

BACKGROUND

The ordinance creating Tax Increment Reinvestment Zone (TIRZ) No. 2 for The Station was approved by the City Council in 2018. That ordinance provides for a percentage contribution of the tax increment (being the difference in property taxes generated in 2018 and the current tax year). Pursuant to the Development Agreement between the City of Sachse and PMB Capital Investments (also executed in 2018), the City’s tax increment contribution is to be used to buy-down the public improvement district assessments against property within the Zone. That arrangement indicates that the City will use a portion of the TIRZ No. 2 revenue to buy down the overall tax stack for properties within the Public Improvement District (PID) No. 1 to equal a rate of $3.15. Since the City Council voted to adopt a lower tax rate of $0.650416 per one hundred dollars ($100) assessed valuation at its September 6, 2022, meeting relating to the 2022 tax year, this action is required to adjust the proportionate buy-down of the tax stack to remain consistent with the terms of the Development Agreement. 

 

The TIRZ Board will meet prior to the Regular City Council meeting on November 14 to review the Amended and Restated Final Project and Finance Plan and make a recommendation to the City Council.

In September 2020, the City Council adopted an ordinance levying assessments on Major Improvement Area and Improvement Area #1 and issued bonds accordingly. Improvement Area #1 levy secures the 2020 bonds and a reimbursement obligation. A subsequent action item provides for the issuance of 2022 Series B bonds in order to retire the reimbursement obligation but remains secured by the same assessments. 

 

This Amended and Restated Service and Assessment Plan and assessment rolls serve as the annual update, as required by the statute, for the rest of the District.

The Public Improvement District Assessment Act (the PID Act), Texas Local Government Code, Chapter 372, as amended, authorizes the City Council to create a Public Improvement District within the City. On January 22, 2019, the Council approved Resolution No. 3905 authorizing, establishing and creating the Sachse Public Improvement District No. 1, and, on December 2, 2019, the Council approved Resolution No. 3958 adding land to the District. In September 2020, the City Council adopted an ordinance levying assessments on Major Improvement Area and Improvement Area #1 and issued bonds accordingly. Improvement Area #1 levy secures the 2020 bonds and a reimbursement obligation/2022 Series B bonds. The previous action item levying assessments on Improvement Areas #2-3 secures these bonds.

 

This Amended and Restated Service and Assessment Plan and assessment rolls serve as the annual update, as required by the statute, for the rest of the District.

This action item is authorized under Chapter 372 of the Texas Local Government Code and is contemplated within the original Development Agreement between the City and PMB Station Land LP that was executed on October 3, 2018.

BACKGROUND

The Public Improvement District Assessment Act (the PID Act), Texas Local Government Code, Chapter 372, as amended, authorizes the City Council to create a public improvement district within the city. On January 22, 2019, the Council approved Resolution No. 3905 authorizing, establishing and creating the Sachse Public Improvement District No. 1, and, on December 2, 2019, the Council approved Resolution No. 3958 adding land to the District. On October 5, 2020, the City Council adopted Resolution No. 3995 determining total costs for certain operation and maintenance services to be undertaken for the benefit of property within the District (the “Authorized Services”), approving a preliminary service and assessment plan and calling for a public hearing to consider the proposed assessments. The City Council held the Assessment Hearing on October 26, 2020, and, upon closing of the Assessment Hearing, the City Council adopted Ordinance No. 3999 approving the "Sachse Public Improvement District No. 1 Operation and Maintenance Service and Assessment Plan.
