[1. Call to Order: The Planning and Zoning Commission of the City of Sachse will hold a regular meeting on Monday, June 24, 2024, at 6:00 PM to consider the following items of business:]

[5. Conduct a public hearing to consider and act upon amendments to Chapter 8 Subdivisions, Chapter 11 Zoning, Section 11-3, and Exhibit 11A, Article 6, and Article 9 to amend platting procedures.]

CHAPTER 11 ZONING.

SECTION 11 DASH THREE AND EXHIBIT 11 A ARTICLE SIX AND ARTICLE NINE TO AMEND THE PLANNING PROCEDURES.

TONIGHT WE'RE HERE TO TALK ABOUT THE UPDATES TO THE PLANNING REGULATIONS.

BASICALLY THE THE ONGOING MAINTENANCE OF REGULATIONS AND THE STREAMLINING OF PROCESSES AND PROVISIONS ARE IDENTIFIED AS TASKS IN THE CITY'S 2017 COMPREHENSIVE PLAN. STAFF IS CONSTANTLY EVALUATING AND UPDATING ORDINANCES BASED ON STATE LAW AND LOCAL GOVERNMENT CODE AS THEY ARE UPDATED.

WE EVALUATE THESE PROCESSES.

AND WORK TOWARDS UPDATING OUR ORDINANCES TO STREAMLINE THESE PROCESSES THAT WE HAVE.

AS IDENTIFIED WITHIN THE 2017 COMP PLAN.

SO TONIGHT WE HAVE PROPOSED A COUPLE OF DIFFERENT ITEMS THAT WILL GO OVER EACH ONE THROUGHOUT THIS PRESENTATION.

TWO MAJOR ITEMS THAT WE HAVE ARE THE THE APPROVAL AUTHORITY CHANGING THAT, AS WELL AS THE THE UPDATES TO LOCAL GOVERNMENT CODE 212 ZERO 15.

SO BACK IN 2013, NOW, HOUSE BILL 3699 APPROVED FOR STAFF TO BE THE APPROVING AUTHORITY ON ALL PLATS.

THAT'S WHAT WE'RE PROPOSING TONIGHT FOR YOU ALL.

AS YOU ALL REMEMBER, PLATS ARE MINISTERIAL AND NON-DISCRETIONARY.

SO IF THEY MEET ALL REQUIREMENTS, THEY HAVE TO BE APPROVED BY Y'ALL.

WITH THE SHOT CLOCK SET IN PLACE FOR 30 DAYS FROM THE OFFICIAL SUBMITTAL DATE OF EVERYTHING BEING OF A COMPLETED APPLICATION. IT KIND OF RESTRICTS WHEN WE'RE ABLE TO TAKE THESE PLATS AS FAR AS THEIR ACCEPTANCE OF APPLICATION.

AND SO OUR GOAL IS TO ESSENTIALLY.

ALLOW US TO APPROVE THESE AND ALLOW FOR MORE FREQUENT SUBMITTALS AND EVERYTHING LIKE THAT.

THIS DOES AFFECT BOTH BIG TIME DEVELOPERS AS WELL AS HOMEOWNERS.

WE'LL GET INTO A LITTLE BIT AS FAR AS THE RESIDENTIAL PLOTS THAT WOULD ALLOW FOR US TO APPROVE THESE RESIDENTIAL PLOTS WITHOUT THEM HAVING COME FORWARD TO Y'ALL. AS FAR AS THE FORMATTING AND VARIOUS PROCESSES.

WE JUST CLEANED UP THE LANGUAGE IN HERE CLEANED UP THE VERBIAGE AS WELL AS ADDING SOME DEFINITIONS THAT WEREN'T CLARIFIED WITHIN THERE.

THE 212 ZERO 15 UPDATE RELATES SPECIFICALLY TO RESIDENTIAL REPLATS ONLY.

AS A REMINDER, THEY ARE MINISTERIAL AND ARE REQUIRED TO BE APPROVED.

BASICALLY, WITH THE CHANGES IN THE LOCAL GOVERNMENT CODE, WE'RE ALLOWED TO APPROVE THESE AT A STAFF LEVEL AND SEND OUT A NOTICE AFTER THE FACT OF APPROVAL TO THOSE SURROUNDING PROPERTY OWNERS.

WITHIN THIS UPDATE AS WELL, WE WERE ALSO PUT IN A APPEALS PROCESS.

SINCE IT IS NO LONGER THE PLANNING AND ZONING COMMISSION APPROVING THESE AND IT'S STAFF LEVEL BASICALLY PUT IN THE APPEALS PROCESS IN CASE WE FEEL THE RIGHT TO DENY SOMETHING IF IT DOESN'T MEET OUR ORDINANCES, THEY HAVE THE RIGHT TO COME FORWARD TO Y'ALL TO SEEK APPROVAL FROM Y'ALL IF THEY SEE THAT AS FIT.

THE LAST THING THAT WE'VE LOOKED AT IS EXPIRING PLOTS.

RIGHT NOW I BELIEVE WE HAVE.

30 DAYS AFTER THE TWO YEARS GOES UP THAT WE'RE ABLE TO EXTEND.

AND WE'RE JUST WANTING TO MOVE THAT TO A 12 MONTH.

SOMETIMES THERE'S DELAYS WITH PROJECTS AND SUCH.

SUCH AS WHEN COVID CAME UP, A LOT OF THESE PROJECTS GOT DELAYED AS WELL AS THERE'S SOME MATERIAL SHORTAGES THAT COME IN, COME INTO PLAY AS WELL.

AND IT ENDS UP DRAGGING THESE PROJECTS A LITTLE BIT FURTHER THAN WHAT THEY'RE EXPECTED.
